For mortgage brokers

The lender wants it witnessed. The client is at work.

Somewhere in most loan files there is a document that has to be signed in front of a witness: an identification declaration, a guarantee, a statutory declaration the lender has asked for. Your client is working during the hours a JP is available, and the file sits open until it's done. We witness those documents by video call, in the evening or at the weekend, with an Australian lawyer.

Where it goes wrong

Settlement is waiting on one signature

A single unwitnessed page can hold a file at the lender for days. The rest of the pack was ready a week ago.

Your client works the same hours a JP does

Asking someone to leave work to queue at a library, or to find a chemist that still has a JP on Tuesdays, is a real cost to them. An evening video call is not.

Guarantors live somewhere else

A parent guaranteeing a first home is often in another town, or another state. Each of them can be witnessed from wherever they are.

You can't be the witness

Brokers are interested parties, and lenders often want an independent witness with a stated qualification. Check the lender's form for who may witness it.

Why use us

A lawyer, on the record

The endorsement names the practitioner, their capacity and the fact the signature was witnessed by audio-visual link. The lender can see who witnessed the document and how.

Open when your clients are free

Sessions run at lunchtime and in the evening on weekdays and through the day at weekends, on demand or booked ahead. The client does it from home.

Questions

Can you witness the mortgage itself?

No. We don't witness land title or property registry instruments, including the mortgage. We can witness statutory declarations, and some other documents such as deeds, where the law allows them to be witnessed by audio-visual link – check the lender's requirements for each.

Will the lender accept a video-witnessed document?

Every jurisdiction we cover permits audio-visual witnessing of statutory declarations by an Australian legal practitioner, and the endorsement records it. Lenders set their own requirements for particular forms, so if a form specifies how it must be witnessed, check it against that. We don't cover documents made under WA or Tasmanian law.

Can the broker sit in on the call?

The session is between the person signing and the practitioner. The signed and witnessed PDF is emailed to the person who signed, who can pass it on to you.
