For migration agents

Commonwealth declarations, witnessed the day the file needs them.

Visa and citizenship files run on statutory declarations: from the applicant, from a partner, from the friend who has known them for years. Each one has to be witnessed before it can be lodged, and the people making them are often working, interstate, or nowhere near a JP. We witness Commonwealth statutory declarations by video call with an Australian lawyer.

Where it goes wrong

Lodgement is waiting on a declaration

The application is otherwise complete. One supporting statement from a relative in another state is holding it up.

Applicants can't always get to a JP

New arrivals may not know where to find one, and shift workers can't get there in business hours. A video call in the evening avoids both problems.

Several declarants, one deadline

Relationship evidence often means statements from several people. Each of them can be witnessed in their own session, from wherever they are.

The wrong witness gets it bounced

A Commonwealth declaration has to be witnessed by a person on the approved list. An Australian legal practitioner is on it.

Why use us

An approved witness

Commonwealth statutory declarations can be made before an Australian legal practitioner, including by video link under the Statutory Declarations Act 1959 (Cth). The endorsement records the practitioner's name and capacity.

Wherever the declarant is

A Commonwealth declaration can be witnessed by video wherever the declarant is, including Western Australia, Tasmania or overseas. State declarations are different – see the question below.

Outside business hours

Sessions run at lunchtime and in the evening on weekdays and through the day at weekends. A declarant can be witnessed on demand or book a time in the calendar.

$39 per document

Charged only once it's witnessed, whether you book a time or connect on demand. Regular volume? Ask about monthly invoicing.

Questions

Can you witness for someone in WA or Tasmania?

For a Commonwealth statutory declaration, yes – the Commonwealth Act applies nationally and the person's location doesn't matter. What we can't do is witness a Western Australian or Tasmanian state declaration or affidavit, because neither state permits audio-visual witnessing.

Does the declarant need an Australian ID?

No. The identity check accepts an Australian driver licence, an Australian passport or a foreign passport, together with a selfie.

Can the declarant use an interpreter?

The practitioner needs to be satisfied the person understands what they are signing. We don't provide interpreters, so contact us before booking if the declarant needs one.

Get the declaration witnessed

Your client uploads the declaration, verifies their ID and signs on a video call with the practitioner. It usually takes about ten minutes.
